WHAT DO I NEED FROM YOU?

 

Notaries are subject to professional rules and regulations and must act independently and impartially at all times. I am required to see evidence of the identity of every signatory and check his or her legal capacity and authority to sign the document that I am asked to notarise.

In the case of a company client, I also have to carry out checks on the company itself. The precise requirements vary depending on the nature of the transaction, but in most cases you will be asked to provide the following:
 

A) For individuals 
 

1. Proof of your identity
Usually this is your current passport, but if you have no passport, a government-issued document containing your photograph and signature, such as a photocard driving licence or national ID card.
 
2. Proof of your address
A recent document that has been posted to you (not printed from the web page) which confirms your address, such as a utility bill or bank statement (no more than 3 months old).
If you don't have any of the above documents, please let me know and I shall advise on any available alternatives.

3. The document to be notarised and any instructions you have received
In advance of your appointment, I shall ask you to e-mail me any documents that you want me to notarise together with any instructions provided by your lawyer or agent in the country where the documents are to be used.  This helps me to meet the requirements of the authorities that will receive the documents and identify any problems with the instruction in advance.


B) Companies (whether incorporated in the United Kingdom or elsewhere)

In addition to providing evidence of your personal identity,

proof of address and other details as per above section A,

you will also be required to provide:

​

1. Proof that the company exists
I am required to establish that the company or organisation that you represent exists and is able to participate in the transaction in question. 

For a company incorporated in the United Kingdom, I will conduct online searches to check the status of the company at Companies House. 

For a company incorporated overseas, I may be able to carry out online checks, but you may be asked to produce proof of the company’s existence and good standing through your lawyer in the country where the company is registered.

2. Proof of your authority
If you are signing a document on behalf of a company I need proof of your authority to sign.  This may take the form of:
•    a Power of Attorney issued in your favour
•    a Board Resolution authorising you to sign documents
•    an Authorised Signatory List

In each case I shall advise on the precise requirements depending on the type of company or other organisation, the nature of the transaction, and the requirements of the country where the documents are to be used.
