In some instances, before a notarial act can be accepted and used overseas, it needs to be legalised. The form of legalisation will depend upon the overseas country involved. Some countries may require the notarised document to be presented to their consulate or other diplomatic representation in the UK or to be certified by an Apostille in accordance with the Hague Apostille Convention, 1961. An “Apostille” is a certificate issued by the UK Foreign, Commonwealth and Development Office ("UK FCDO") and attached to the notarial act to confirm the signature and seal of the notary. Some other documents, such as UK birth and marriage certificates, can be directly legalised or apostilled without being authenticated by a notary.

This legalisation process where a certification is required by the overseas country's consulate or their diplomatic representation in the UK, may vary, both in terms of timings and requirements from one country to another. An Apostille takes at least 4 working days for the document to be returned back in the UK, with UK FCDO agency services and least 2-3 weeks for the document to be returned back in the UK, with UK FCDO postal service.
